These Terms and Conditions govern the use of the My Island Box website (the “Site”) and the services we offer. By accessing the Site or placing an order, you agree to comply with these Terms and Conditions. If you do not agree with these Terms, please do not use our Site.

1. Purpose
These Terms of Service govern the purchase of fresh food products from My Island Box B.V., available exclusively through delivery (French and Dutch sides of Sint Maarten) or at designated Pick-Up Points.
2. Products
• Products are fresh and perishable, prepared on demand.
• Photos and descriptions are for illustrative purposes and may differ slightly from the actual product.
• My Island Box complies with all required food safety, hygiene, and licensing regulations applicable in Sint Maarten.
3. Orders
• Orders become binding once confirmed and paid.
• Cancellations or modifications are only possible before preparation begins.
• My Island Box reserves the right to refuse any order for legitimate reasons, including lack of availability, suspected fraud, or safety concerns.
4. Prices and Payment
• Prices are displayed in EUR or USD.
• Accepted payment methods: credit card (TPE or payment link), cash, and bank transfer.
• Orders are only confirmed after payment has been received.
5. Delivery and Pick-Up
• Delivery is available on both the French and Dutch sides of Sint Maarten.
• Delivery times and zones are communicated at the time of order.
• Pick-up orders must be collected within the specified timeframe.
6. Returns and Refunds
• Due to the perishable nature of our products, no returns or refunds are accepted once products have been delivered or picked up.
• Exceptions: errors in preparation or damaged products. In such cases, customers must notify us immediately and provide proof (photo or return at the pick-up point).
7. Liability
• My Island Box B.V. is not liable for delays caused by force majeure events (weather, traffic, strikes, accidents, unforeseen circumstances).
• Responsibility for correct handling and storage of food after delivery or pick-up lies with the customer.
• Liability is strictly limited to the amount of the order concerned.
8. Indemnification
The customer agrees to indemnify and hold harmless My Island Box B.V. from any claims, damages, or liabilities resulting from misuse of the products, improper storage, or non-compliance with provided instructions.
9. Governing Law & Dispute Resolution
• These Terms are governed by the laws of Sint Maarten (Dutch side).
• In case of dispute, parties agree to attempt amicable resolution first.
• Failing that, disputes will be submitted to the competent courts of Sint Maarten.
• Class actions or collective lawsuits are expressly waived to the extent permitted by law.
